The FIR was registered at Ramna police station under Section 505( hate speech) and Section 138 of the Pakistan Penal Code.
Section 138 reads “ Whoever abets what he knows to be an act of rebellion by an officer, dogface, seaman or birdman, in the Army, Navy or Air Force of Pakistan, shall, if similar act of rebellion be committed in consequence of that assist, be penalized with imprisonment of either description for a term which may extend to six months, or with fine, or with both.”
According to the operation seeking the enrollment of the FIR, Mazari (Shireen mazari’s) made a “ depreciatory and abomination( sic) statement on May 21 ” against Pakistan Army and its principal General Bajwa.
Mazari “ abused the elderly military leadership of the Pakistan Army ”, the operation filed by Syed Humayun Iftikhar, Lt Colonel for Judge Advocate General, GHQ, stated as it sought enrollment of a case against Mazari.
“ Her depreciatory statements are largely disparaging aimed to beget and incite insurgency/ intimidation amongst species and train of( the) Pakistan Army, ” it stated, adding, “ It also leads to sport and produce abomination within the Pakistan Army which made out( sic) a serious offence. ”
It contended Mazari also defamed the elderly military leadership as these “ statements, made with the intent to beget and produce uneasiness and chaos in the Pakistan Army ” which is a “ punishable offence ”.
According to the statement, “there is reason to believe that a similar act (sic) would harm the role of the military and senior leadership. The operation called for legal action against Mazari for the crime against the state.” ۔
It may be noted then that after the Punjab government receded itself from Shireen Mazari’s arrest, her son Imaan indicted Gen Bajwa and the army of being behind the detention of her mama.
The service has been indicted of enforced discoveries by rights activists. It’s intriguing that the service has decided for the legal course for “ justice ”, which could be a test case for the country’s felonious justice system.
The country’s Constitution and law give protection to the fortified forces against vilification and sport. And judges say the court ruling in this case could set a precedent.
